WEBSITE TERMS OF USE AND PERSONAL DATA PROTECTION
Article 1 – General provisions – contact details of the website owner
These terms and conditions apply to the use of all websites (including mobile websites), including any components and applications created or owned by the entity whose full contact details are provided on the “Contact” page.
The term “User” refers to any person who accesses the Sites (the “User”).
By using the Sites, the User fully and unconditionally accepts the applicable Terms and Conditions and agrees to comply with them.
If the User does not accept the Terms and Conditions, they must refrain from using the Sites and/or Services.
In the event of non-compliance with the Terms and Conditions, the Company reserves the right to refuse access to the Sites, without prejudice to its right to claim compensation from any third party for any direct or indirect damage resulting from such non-compliance.
The Company reserves the right to amend all or part of these Terms of Use at any time without prior notice.
Users are therefore advised to consult the Terms of Use regularly in order to remain informed of the most recent version.
Article 2 – Use of the Sites
Use of the Sites is, in principle, free of charge and unrestricted.
To use certain Sites, the User may be required to register, provide certain information and/or create an access code and/or password.
If the User refuses to do so, the relevant parts of the Sites will not be accessible.
If the use of certain Sites is subject to payment, the User will be informed in advance of the applicable conditions, prices and payment methods.
The Company grants the User a non-exclusive and non-transferable licence, for an indefinite period, allowing the User to download content from the Sites solely for the purpose of displaying it on a single computer.
This licence may, however, be revoked at any time without justification.
The User may also print one copy of the content of the Sites for personal use, provided that no changes are made to the content.
The Sites may only be used for personal and private purposes by individuals and exclusively for internal purposes by professionals.
Consequently, any commercial use of the Sites is strictly prohibited.
Users agree not to perform any act that could destroy the Sites or disrupt their proper functioning.
In the event of abuse or improper use, the Company reserves the right to suspend and/or terminate the User’s access to the Sites without prior notice or formal demand.
Article 3 – Copyright and database producer rights
All copyrights, trademarks, patents, intellectual property rights and other property rights applicable to the Sites shall at all times belong to the Company.
The Sites and/or Services constitute both works protected by copyright and databases in respect of which the Company holds copyright and database producer rights.
The texts, layouts, designs, photographs, films, graphics and other elements of the Sites are protected by copyright.
The copying, adaptation, modification, translation, arrangement, public communication, rental or any other form of exploitation of all or part of the Sites, in any form and by any means whatsoever, including electronic, mechanical or other means, is strictly prohibited without the Company’s prior written authorisation.
Any infringement of these rights may give rise to civil or criminal proceedings.
Article 4 – Trademarks and trade names
The names, logos and other signs used on these Sites, including the Company’s logos and names, are legally protected trademarks and/or trade names.
Any use of these or of similar signs is strictly prohibited without the Company’s prior written authorisation.
Article 5 – Liability
The Company will make every effort to ensure the proper functioning of the Sites.
Except in cases of intentional misconduct and/or where mandatory legal provisions provide otherwise, the Company accepts no liability for any loss or damage, whether direct, indirect, material, immaterial or otherwise, resulting from:
(1) the content of the Sites. The Company does not guarantee the accuracy, adequacy or completeness of the information provided on the Sites. Information available on the Sites, including information relating to products and services offered for sale, may be amended without prior notice. The Company takes the utmost care in creating, updating and maintaining the website. Nevertheless, if the User identifies inaccurate or outdated information, harmful or unlawful content, or believes that any of their rights, whether intellectual property rights or otherwise, have been infringed, the User is strongly encouraged to report this;
(2) the use made of the Sites;
(3) the security of the Sites. This provision applies in particular to any viruses, errors or computer fraud;
(4) the accessibility and/or availability of the Sites. The Company does not guarantee the permanent availability, through all technical means, of all functions of the Sites without errors or interruptions, nor the immediate correction of errors or restoration of interrupted services.
The Company also reserves the right to refuse access to or discontinue the Sites and additional Services at any time and without prior notice.
Under no circumstances may the Company be held liable for services and/or products, or for their invoicing, where these are offered by third parties and accessible through the Sites, even if the Company receives remuneration in this respect or invoices such services and/or products on behalf of third parties.
Where the Company’s liability is established, its liability shall be limited to the amount of EUR 100.00.
The above limitations and/or exclusions of liability shall apply insofar as they are valid under applicable law.
Article 6 – Privacy – processing of personal data
The Company and the User undertake to comply with the applicable legislation governing the processing of personal data and, in particular, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).
The Company collects and processes identity data and contact details received from the User and any other relevant contact person.
The purposes of this processing include the performance of an agreement, customer and order management, accounting and direct marketing activities, such as sending promotional or commercial information.
The legal bases for such processing are the performance of a contract, the User’s consent, compliance with legal and regulatory obligations and/or the Company’s legitimate interests.
The aforementioned personal data will be processed in accordance with the provisions of the General Data Protection Regulation and, unless otherwise agreed by the User, will only be disclosed to processors, recipients and/or third parties insofar as necessary for the aforementioned purposes.
The User is responsible for ensuring that the personal data provided to the Company is accurate and up to date and undertakes to strictly comply with the provisions of the General Data Protection Regulation with regard to persons whose personal data they have provided, as well as with regard to any personal data they may receive from their own customers.
Personal data shall be retained and processed for as long as necessary depending on the purposes of the processing and the contractual or non-contractual relationship.
In all cases, Users’ data will be removed from our systems after a period of seven years or, in the case of a contract, seven years after the end of that contract, except for personal data that we are legally required to retain for a longer period or where ongoing legal proceedings require the personal data to be retained.
By providing their consent when entering or communicating their personal data, by voluntarily continuing to browse the Sites, or when entering into a contract with the Company, the User consents, in addition to the processing described above, to the collection and use of their personal data as set out below.
The Company collects personally identifiable information including name, address, telephone number, email address, VAT number, total number of visits to the website, number of visitors to each page of the website, domain names of visitors’ internet service providers, IP addresses and cookies.
The User agrees that their data may be used and transferred to third parties for advertising, commercial or marketing purposes and consents to receiving information from the Company or its partners by email, including newsletters, or by post.
Right of access: the User has the right to ask at any time whether their data has been collected, how long it is retained and for what purpose.
Right to rectification: the User has the right to request at any time that inaccurate or incomplete data be corrected or completed.
Right to restriction of processing: the User may request that the processing of their data be restricted. This means that the data concerned must be “marked” in our IT system and may no longer be used for a certain period of time.
Right to erasure (“right to be forgotten”): subject to the exceptions provided for by law, the User has the right to request the deletion of their data. If the User wishes to withdraw the Company’s ability to use their personal data, they may simply write to the address referred to in Article 1 or provided on the Contact page.
Right to data portability: the User may request that their data be provided to them in a “structured, commonly used and machine-readable format”.
Right to lodge a complaint: the User may lodge a complaint with the Data Protection Authority.
The Company undertakes to implement appropriate technical and organisational measures to ensure an adequate level of security and to protect the confidentiality of personal data.
The Company shall notify the customer of any personal data breach of which it becomes aware.
Article 7 – Hyperlinks
The Site may contain links to other websites.
As the Company has no control over these websites, it cannot be held responsible for their availability.
The Company accepts no liability for any content, advertising, products, services or other materials available on or through such websites.
Furthermore, the Company shall not be held liable for any actual or alleged damage or loss arising from or in connection with the use of, or reliance on, any content, goods or services available on such websites.
Article 8 – Cookies
A cookie is a small text file saved by a website server in the browser of your computer or mobile device when you visit a website.
The cookie contains a unique code that allows your browser to be recognised during your visit to the website (“session cookie”) or during future repeat visits (“persistent cookie”).
Cookies may be placed by the server of the website you are visiting or by partners with whom the website cooperates.
A website server can only read the cookies that it has placed itself and does not have access to any other information stored on your computer or mobile device.
Cookies are stored on your computer or mobile device in your browser directory.
A cookie generally contains the name of the server that placed the cookie, an expiry date and a unique encrypted code.
Cookies generally make interaction between the visitor and the website easier and faster.
They also help visitors navigate between different parts of the website.

Article 9 – User contributions
Users may submit content, including video, audio, text and photographic material, in certain areas of the Sites (hereinafter referred to as “Contributions”).
Users expressly authorise the Company to reproduce these Contributions on the Sites and thereby make them publicly available via the internet worldwide and without any time limitation, without being entitled to any financial compensation or other consideration.
Users are fully and solely responsible for the content of their Contributions and for the consequences of their publication through the Sites.
Users guarantee that they hold all rights and/or authorisations necessary for the publication of their Contributions on the Sites as described above.
Users shall indemnify the Company against any complaint, claim or action brought by a third party or supervisory authority in connection with their Contributions.
The Company does not carry out any prior review of Contributions.
However, it reserves the right not to publish or to remove from its Sites any unlawful Contribution or any Contribution that may reasonably be assumed to infringe the rights of third parties, without prior notice to the User who submitted the content concerned.
Article 10 – Jurisdiction and applicable law
Belgian law shall apply to the Sites.
The courts of the judicial district in which the Company’s registered office is located shall have exclusive jurisdiction over any disputes arising from the use of the Sites.
